MAYOR PRO TEM HUNTER:           Call to order.  We’ll be led in our prayer by Pastor Daniel Morris from the First Church of God and Alderman Hank Williams will lead us in the Pledge of Allegiance.

 

PASTOR  MORRIS:   Let us pray. God, our Father, we come before You this hour, first of all, to say thank You.  Thank You for Your sovereign guidance upon this nation.  Thank You for the freedoms that we enjoy.  Thank You for the men and women who put their lives in harm’s way to protect those freedoms.  Thank You, also, for those who give of their time to serve as leaders in government, whether it be on a national, state or local level.  We especially pray at this moment for the leaders who are assembled here tonight, for the Mayor and Council Members.  Father, we would ask that You grant to them wisdom in their deliberations and may the decisions that are made be for the betterment of the people of Kankakee.  May their work be done in a spirit of unity and cooperation, and even in diversity of opinion, may there be oneness of action.  And, Father, in the spirit of the season, we pray for peace on earth and good will to all.  In Your holy name we pray.  Amen.

ALDERMAN WILLIAMS:     Yes, Your Honor, ah, in reference to the Public Safety meeting that was held on December 8, 2009, the only thing that stands out here was the Department received a grant in the amount of $253,953.00 to assist with personnel and new equipment for the KAMEG unit.  And, ah, I motion to approve that we approve this.

ENFORCEMENT GROUP

 

MAYOR PRO TEM HUNTER:           Motion passes.  Thank you very much Council members.  Budget Committee.

 

ALDERMAN BARON:           There’s no items that we’re asking for action on, but the second item.....the second major item, the discussion of the Fire and Police Pension Fund actuarial results is a good explanation and a good discussion of why the levy increase is in the amount that is.  Last meeting, you’ll recall, we discussed the fact we had just received that very day, the updated actuarial requirements for the Police and Fire Pension Funds which was an additional $900,000.00–over $900,000.00 from what we had thought.  And, ah, as I said, we’re not asking for approval of anything from the Budget Committee, but that........the minutes stand as a good explanation as to why the levy is going to be up more than $900,000.00 this year.

 

MAYOR PRO TEM HUNTER:           Your comments, Alderman, and the minutes, are quite explanatory regarding the levy so we duly appreciate your comments.  Ah, there are no other Standing Committee reports.  Reports of Officers and approval of the bills, Alderman Hank Williams.

REPORT OF OFFICERS APPROVAL OF BILLS  $313,190.02

 

MAYOR PRO TEM HUNTER:           Motion passes.  We’d like to move onto Unfinished Business.  The first item is the Ordinance levying property taxes for all corporate purposes for the City of Kankakee, Kankakee County, Illinois, for the fiscal year commencing on May 1, 2009, and ending April 30, 2010.  This will be the second reading.

 

ALDERMAN BARON:           Mr. Mayor Pro Tem, the, ah, I would move that we place this on second reading and pass it.  In doing so, I’d just like to clarify the fact that the numbers........that the correct numbers as we discussed two weeks ago and as are clarified right now, are the Firefighters Pension figure is $2,046,132.00 and the Police Pension is $1,794,582.00.  That creates an increase in the amount of 21.5% for the truth in taxation levy and blended with the debt service creates an increase in our levy request of 16%.  That’s up from the figures that we saw last time and they’re up entirely 100% because of the increase within Fire Pension from last year which is 46% increase.  This is the amount that we’re required to pay pursuant to our, ah, consent decree.  And, the Police Pension increased 39.8% and the Illinois Municipal Retirement Fund is up 38%.  Everything else, every other line item for General Corporate purposes is zero or down.

MAYOR PRO TEM HUNTER:           Okay, I’ll entertain that motion.  Alderman Baron, is there a motion?     

 

ALDERMAN BARON:           That........I started out by saying that was a motion.

 

MAYOR PRO TEM HUNTER:           Okay.

 

ALDERMAN BARON:           But, I’ll reiterate that.

MAYOR PRO TEM HUNTER:           There’s been a second by Alderman Glen Davidson from the First Ward.  Any questions, comments, concerns?  I think......Alderman Jones.

 

ALDERMAN JONES:             Yes, under these times when the people of the City of Kankakee who are right now paying 11% property tax that is over the Bourbonnais tax, if we go up 8 ½ % property taxes tonight it will put us at–or 7 ½% property tax tonight– will put us at 18 ½% property tax?

 

ALDERMAN WILLIAMS:     Mayor.

 

MAYOR PRO TEM HUNTER:           Yes, Alderman Williams.

 

ALDERMAN WILLIAMS:     I know that paying the taxes and increased tax is a burden on a lot of people.  But, through our various discussions–we have been over this before, for the sins of our past fathers of the City, we are in this predicament right now where, if we violate this mandate, it’s going to turn around and bite us like them pit bulls we’ve been talkin’ about in past meetings.  And, even though we would like to dodge this bullet, I don’t see no way that we can.  It’s a mandate.  It’s a court order and if we’d be in violation of that, then we’re going to suffer a worse peril than we think.

 

MAYOR PRO TEM HUNTER:           Let me try to get a response.  Thank you very much for your comments, Alderman Williams.  Mr. Spice, did you understand or hear the comments made by the junior Alderman from the Second Ward?

 

JAMES SPICE:           I did.

 

MAYOR PRO TEM HUNTER:           Okay.  And, what is your response?

 

 

JAMES SPICE:           Well, again, the levy is a requirement.  The pension levies are a requirement that we........that the City has agreed to through a legal process and that amount has been generated over the years because the City had taken action years and years ago, not to properly fund the pension funds.  And, now, in order to keep up, there was a time coming which our forefathers knew, that we would have to pick this up.

 

MAYOR PRO TEM HUNTER:           Well stated.  Okay, Alderman Jones.

 

ALDERMAN JONES:             I had the Floor before Alderman Williams.  Ah, I know we have a mandate for the tax increase for the....... to pay the Fire and Police Pensions.  Is it mandated to put it on the property tax is my question?  Or is mandated that we pay it?

 

ATTORNEY BOHLEN:          It is a mandated..........it is a levy.  The City is.........the answer to your question is yes.  Yes, it is to be levied as a property tax in order to obtain for the pensions.  It is a specific line item in the levy.  To go back to your statement, the issue that I think I heard you say is you’re concerned that we are currently at almost $11.00 per hundred on the tax bills.  That we’ll go to $18.00.  No.  We’ll go from $10.80 and add 80¢ onto it which is 8% which is what the percentage increase is.  It doesn’t go from $10.00 to $18.00.  It’ll go from $10.80 or whatever the current rate is and add another 80–or 8%–to that which would be another, basically 80¢.

 

MAYOR PRO TEM HUNTER:           Alderman, are you clear on that?  Last Council meeting we discussed that and we had a public hearing on the matter.  You heard.

 

ALDERMAN JONES:             And, we had seven people getting up from.......

 

MAYOR PRO TEM HUNTER:           This is America and you’re given the opportunity.....

 

ALDERMAN JONES:             indistinguishable  foreclosures in my Ward right now and I don’t want to see any more people lose their homes and the other thing is, is we have a grant coming to rehab, but if the taxes is too high, the people might leave.

MAYOR PRO TEM HUNTER:           Motion passes.  Okay, moving right along to Item D, Recommendation to Award the Contract in the Amount of $53,698.00 to Oakwood Enterprises.  My understanding it’s a local Kankakee business.  Is that right, Dave?

 

DAVID TYSON:         That’s correct.

 

MAYOR PRO TEM HUNTER:           I’m glad to hear that.  For the proposed drainage improvements at the Norfolk Southern railroad crossing on Fifth Avenue.  Do you want to give us some explanation comments on this?

 

DAVID TYSON:         Ah, yes, this is a project that we’ve been looking at.  It’s over on the curve of Fifth Avenue just north of the Norfolk Central Railroad.  Pangle Chiropractic used to be in that area.  We’ve had a constant water problem there with water standing on the west side of the street.  We looked at several different options.  The closest option right now we have to get rid of the water is to actually bore underneath the railroad track and go to the south and install storm sewers in there to get rid of this.  We’ve temporarily actually taken out a section of curb and some sidewalk to try to get the water off the street into the yards right now because we’re afraid of icing projects.  This is in a TIF District–the Meadowview TIF District. The reason we’re letting it right now–this TIF District does go out at the end of the year and we want to get this included in the TIF dollars to pay for it.

WORKS FUEL BID TO BARON-HUOT OIL COMPANY

 

MAYOR PRO TEM HUNTER:           Motion passes.  An Ordinance Regulating Development in Flood Plain Areas.  That’s the first reading.  Dave, you want to give us some comments on that?

 

DAVID TYSON:         Sure.  What this has to do with is, the County is receiving all new flood plain maps, both the City and County and all the other municipalities within it.  These maps are actually dated January 20, 2010.  So, in order to adopt the maps that we’re basically told we have to adopt, some changes in Kankakee, but mostly for the betterment.  It lowers the flood plain a little bit and that.  You have to pass a new Ordinance.  If you don’t pass our Ordinance by January 20, 2010, our residents that are within the City and are part of a nationwide insurance program–flood insurance program–would no longer be eligible.  So, what I’ve done is I’ve gone through the Ordinance.  I’ve rewritten it.  I’ve made sure we concur with the new recommendations that they have and still cover everything that’s supposed to be in our old Ordinances.  So, this will be replacing the Ordinance that was passed in 2003.

ORDINANCE REGULATING DEVELOPMENT IN FLOOD PLAIN AREAS

 

MAYOR PRO TEM HUNTER:           Motion passes.  There are no Appointments.  We want to move to Motions and Resolutions.  This is an agreement–intergovernmental agreement–that will be entered into with the City of Kankakee and Sun River Terrace regarding the Administrative Adjudication process which we house here.  I’ll entertain a motion to approve this.

RESOLUTION AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF SUN RIVER TERRACE AND THE CITY

OF KANKAKEE REGARDING THE ADMINISTRATIVE ADJUDICATION PROCESS

OF KANKAKEE ON BEHALF OF SUN RIVER TERRACE

 

MAYOR PRO TEM HUNTER:           Motion passes.  Okay, Aldermen comments or questions?  Yes, Alderman Swanson.

 

ALDERMAN SWANSON:     Ah, there will not be an Ordinance Meeting tomorrow night.  There is nothing–no new business to discuss so we won’t be having one.

 

MAYOR PRO TEM HUNTER:           Any other comments?  Alderman Carl Brown.

 

ALDERMAN BROWN:          I would just like to wish all my seat mates a Merry Christmas and Happy New Year in case I don’t see you.  And, ah, I just want to let you know, you can bring my present any time.

ATTORNEY BOHLEN:          Don’t wait, Carl.

 

MAYOR PRO TEM HUNTER:           Okay.  I was going to mention the same thing, too.  Since there’s no Executive Session needed regarding any personnel or pending litigation I wanted to also wish the citizens of the City of Kankakee, the Mayor, City Council, employees and department heads a safe and merry Christmas and a most prosperous new year.  I’ll entertain a motion..........anybody else with any comments, well wishes?

 

NANCY SMITHBERG:          Mayor Epstein is a grandma.

 

MAYOR PRO TEM HUNTER:           Oh, yes, Mayor Epstein is an aguila.  I think the baby was 6 pounds, 14 ounces.

 

NANCY SMITHBERG:          Um huh (affirmative).  

 

MAYOR PRO TEM HUNTER:           Madeline Elizabeth.

 

NANCY SMITHBERG:          Um huh (affirmative). 

 

MAYOR PRO TEM HUNTER:           And, I talked with the Mayor today and she advised me that she had the 4:00 – 8:00 A.M. shift this morning.  So, she’s bright-eyed and bushy-tailed.  So, we’re pleased with that.  But, I just wanted to wish nothing but good things to all the citizens of the City.  I’d entertain a motion to adjourn.

ALDERMAN WILLIAMS:     Second.

 

MAYOR PRO TEM HUNTER:           Motion to adjourn by Alderman Osenga and seconded by Alderman Hank Williams.  All those in favor signify by the sign of aye.  Opposed same sign.
